Can: Your Rights As Home Owners As homeowners you have the right to know what is going on in your Community Association. Like any corporation you buy shares in, you own them and get the right to vote those shares. In a very democratic process, HOA and Condo Associations may elect and recall their board members by voting one share for each lot, condo, townhome, etc. Here are some interesting points about these unique democratic non-profit corporations: The number of units in a community association equals the number of shares in the non-profit corporation Homeowners get one voter per unit no matter how many owners As a corporation, all associations must call for an annual meeting to elect the board of directors HOA annual meetings are very rare because a quorum is required of usually 30% of the owners who vote at the meeting or by proxy Condo annual meetings are very common because they cast their ballots by mail without proxies Most HOA directors are appointed because elections are so rare If you do want to know what is going on with your Community Association Florida law allows an owner to obtain copies of any community association document they want (except, personnel, legal, and such). If the Association does not provide the document within ten days, the Association could be fined $50 a day up to ten days penalty. Management companies can charge 50 cents per page to keep this homeowner right from being abused. But you can request to see them, and not copies of them —
